Land rights news

News - (property knowledge). Buying and selling of property is one of the biggest deals these days. There are many rules related to buying and selling it (property selling rights). Not everyone can buy or sell it. Especially regarding ancestral or ancestral land, the question arises that which member of the family can sell the ancestral land.

Since ancestral land is a joint property, many members of the family have rights over it. But which member has the right to sell this property? Know in the news who is that member in the family.

There are two types of assets-

The legal provisions for selling ancestral property are quite different from self-acquired property. If ancestral land is sold without the consent of the members associated with this property, they can also make a claim in the court. But despite this, there is a member of the family who can sell the ancestral land at any time.

There are different rules for selling ancestral property.

Any person acquires land in two ways, one is by his own earnings, which is called self-acquired property. Self-acquired property also includes property given as gift, donation or by someone by giving up their rights.

The second property is ancestral property (ancestral property rights) which is not from one's own earnings but is received by the father from his ancestors. Ancestral property cannot be sold to anyone like self-acquired property. The rules (property selling rules) regarding selling it are somewhat different.

Who has the right to sell ancestral land-

Four generations of family members have rights over ancestral property. This property cannot be sold by any one person at his own will like self-acquired property. Nor can it be sold based on the decision of other claimants.

To sell ancestral land or property, the consent of every member associated with it is necessary. Sons and daughters also have ancestral property rights. This property can be sold if everyone agrees.

You can go to court if you wish

If someone does whatever he wants to sell the ancestral property (property knowledge), then another member can go to court. If any member of the family sells the ancestral land (ancestral property selling rights) without consent, then other heirs and rightful owners can go to court.

It can be stopped from being sold by sending a legal notice. In such a case, a stay can be put on the sale of the property, if the sale has been done then it can be cancelled.
