Can a husband evict a wife from the house or a husband evict a wife from the house?

A Mumbai court has given its verdict in a domestic dispute case. A wife had demanded that her husband be evicted from the jointly purchased house. The court said that the husband has a legal right over the house and cannot be evicted. 

However, the court also said that the husband has a moral duty to live in the same house with his wife and daughters and take care of them, as the wife and daughters are living separately.

The court ordered the man to pay Rs 17,000 every month to his wife as maintenance. The maintenance will be paid from August 2021 when the woman first approached the court.

What does the law say?

In India, a wife has a right over her husband's property only under the authority of law. If the husband and wife decide to separate after marriage, then the woman can ask for alimony from her husband under Section 24 of the Hindu Marriage Act. 

At the same time, under the Domestic Violence Act and 125 CrPC, women can ask for alimony from their husbands for life.

Under the Hindu Adoption and Maintenance Act , 1956, a Hindu wife has the right to live in her in-laws' house even if the house is not owned by her husband or in-laws. 

This right applies to ancestral, joint family, self-acquired or rented house. This right of the wife remains as long as she is in a marital relationship with the husband. In case of separation, she can claim maintenance.

A person has full rights over the property acquired by him, such as land, building, money, or jewellery. He can sell, mortgage, bequeath, or even donate this property. All rights related to it are reserved with him.
