This decision was given by Gujarat High Court-

While giving its verdict in a case related to retired employees, the Gujarat High Court has said that if any government employee is convicted and sentenced by the court for a serious crime, then the state government can stop his pension (court decision on pension).

There is no need for a show cause notice for this. That is, the state government can take action even in case of punishment after retirement. Even if the employee is found guilty of a serious crime during service, the government can stop the pension (govt pension rules).

A two-judge bench of the Gujarat High Court (Gujarat High Court News) said that Rule 23 of the Pension Rules-2002 provides that if a pensioner is found guilty of a serious crime, the government can stop his pension and can also take it back by recovering it. The government can take action even if a regular employee (govt employees news) is found guilty.

Authority can take decision at any time-

The High Court said that if any appeal is pending in the High Court against the decision of the lower court in case of a serious crime (pension stop on serious fraud), then the authority is not bound to wait for the decision on the appeal to take its action, the authority can take the decision beforehand. 

The guilty employee in this case was -

This case is related to a retired employee who was found guilty in a corruption case during service. Apart from being convicted in the case including the charge of corruption (punishment in corruption), the employee had challenged the departmental action taken to stop the pension. The court has given its important decision (HC decision on pension) while hearing this case related to all these matters. 

The High Court made this remark -

In this case, the employee had also challenged the action taken by the pension department to stop the pension. The High Court commented that the pension department can do its work according to the rules and stop the pension. 

Before taking its action, the pension department is not bound to issue a show cause notice to the pensioner or give him a chance to be heard, it can take action.

Action can be taken during service time also-

The decision of the Gujarat High Court (Gujarat High Court News) makes it clear that the government can stop the pension of the pensioner (high court decision on pension) if he is convicted of a serious crime. 

This decision also makes it clear that if any employee or officer of the state government is found guilty of any serious crime like corruption during his service time or after retirement (retirement rules), then the state government can stop his pension.
