This is how a raid is conducted-

Those who save tax illegally (how to save tax) sometimes get caught in the clutches of the Income Tax Department. The Income Tax Department raids the places of those who evade tax or save tax fraudulently. 

Income Tax Raid According to Section 132 of the Income Tax Act, the officer can raid the business place or house of any person or taxpayer (IT raid rules). 

There is no fixed time for raiding-

There is no fixed time for the raid. The raid can last for any length of time. The team can search any person present there. The department's team can even break the locks to gather information during the raid (why does an IT raid take place). The team also takes the help of police and security personnel. 

Raids are also conducted for tax evasion-

The Income Tax Department, Central Board of Direct Taxes and Enforcement Directorate (ED) have the right to raid the premises of tax evaders. 

The Income Tax Department team conducts raids on the basis of information and suspicion of finding difference between tax (tax rules) and annual income or tax evasion or black money accumulation. 

No one is allowed to have a clue -

Whenever and wherever an Income Tax raid takes place, no one is even allowed to know about it. Neither the person whose place is raided nor the team members know when and where the raid will take place. 

The person concerned is not even allowed to guess about it. The department follows this formula that the person whose place is raided should not get any chance to recover. 

At this time the raid is conducted-

There is no fixed time for income tax raids, but in most cases the raid (IT raid time) is conducted early in the morning or late at night so that the accused cannot escape or recover. 

The raiding team also has a warrant (IT raid ka warrant) to search the house. When the raid is conducted, the income tax officials may be accompanied by police force and paramilitary forces. During the raid (income tax ki raid), the people present in the house or office can neither go out nor come inside without the permission of the income tax officials.

What items can be confiscated? 

If income tax raid is conducted in a shop, establishment or showroom, the goods kept there for sale cannot be confiscated by the team. It is also the right of the showroom and shop owner to ask for not confiscating the goods. 

However, the team (income tax team) can note these goods and the documents related to these goods can be confiscated. If a large amount of cash or gold or other valuable goods are found in the raided shop or showroom and there is a complete record of all this and it has been filled in the ITR (income tax return), even then the team cannot confiscate those goods.

These are the rights of a person during a raid-

During a raid, the person whose place is being raided also has many rights (taxpayer's rights). The person concerned can ask the raiding officers and team to show the warrant and identity card. 

Only the female staff of the team can search any other woman present there. Even if there is a suspicion of something being hidden in the woman's clothes, the male staff or officer cannot search her. 

Cannot stop children from going to school

No employee of this team can stop the person concerned from eating food or the children from going to school during the raid (income tax raid rules). However, permission has to be taken for eating food. Children's school bags can be checked. 

Where does the confiscated goods and cash go?

The cash seized during the raid is deposited in the bank account linked to the commissioner of the income tax department. The cash and other things seized during the raid are also examined. After a complete assessment of this, the tax amount that has been stolen or hidden is deducted. The remaining amount and goods are returned to the person whose place is raided.
